Contract
Whereas the Buyer wishes to purchase from the Seller
a black male puppy out of the above named Sire and Dam. The Buyer
has included with this Purchase Contract a deposit of $200.00. The Seller
agrees to refund the total deposit to the Buyer in the event the Sire and Dam
named above do not whelp a puppy of the desired color and sex stated above.
If the Sire and Dam named above whelp a puppy of the desired color and sex
stated above the Buyer understands that the deposit is non-refundable. If paying
by check, Seller must receive the balance of the Total Purchase Price (plus
any shipping costs) at least one week prior to the Buyer taking possession of
the puppy or else payment must be made with certified funds.
Seller Warrants and Agrees:
1. The Seller is the lawful owner of the dam, and has full legal right to
sell her offspring,
2. The puppy is in sound body and good health at the time of transfer. The
Seller will provide to the Buyer record of worming and inoculations. Buyer is
instructed to consult with their veterinarian for advice regarding
inoculations and additional worming (fecal test).
3. Buyer is to arrange a checkup of the puppy by a qualified veterinarian
within 48 hours of taking possession of the puppy. Seller shall be notified
immediately in the event that the puppy has a health defect. If the
veterinarian determines that the puppy has a health defect the Buyer is
entitled to a full refund of the puppy's purchase price upon the return of
the puppy to the Seller within 5 days of taking possession, together with the
puppy's AKC registration papers which are to be signed over to the Seller.
Seller will not reimburse any veterinary expenses incurred by the Buyer.
Sellers' warranty is limited to the refund of the puppy's purchase price upon
return of the puppy, and only under the circumstances described above.
4. This puppy is guaranteed to be O.F.A. certifiable at two (2) years of
age. The puppy must be x-rayed by thirty (30) months of age, and the x-ray
submitted to the O.F.A. for examination and certification. If the O.F.A.
finds the puppy to be dysplastic, the following requirements must be
fulfilled in order to obtain a replacement puppy or refund of the purchase
price:
a. The O.F.A. shall be the sole judge regarding hip dysplasia.
b. The Seller is to receive a copy of the O.F.A. written report.
c. If the puppy is determined to be dysplastic, the puppy will be replaced
upon return of the puppy's AKC registration papers, which are to be signed
over to the Seller. The Buyer may keep the dysplastic dog or give it to
someone else, but it must be neutered or spayed, and the Buyer must provide
the Seller with written proof of this from the veterinarian who performs the
surgery.
d. All freight charges are to be paid by the Buyer.
e. A replacement puppy may be chosen from any breeding the Seller has
available that is similar to the original purchase price. If the Buyer
chooses a puppy from a more expensive litter, the Buyer would be required to
pay the difference.
f. This guarantee applies only to the Buyer stated in this Contract and is
non-transferable.
5. This puppy is guaranteed to be certifiable against heritable eye
diseases. By thirty (30) months of age, a Board Certified Veterinarian
Ophthalmologist must examine the dog. CERF shall be the sole judge of
hereditary eye problems. A written report must be submitted to the Seller
along with written proof that the puppy has been neutered or spayed and the
puppy's AKC registration papers must be signed over to the Seller in order to
receive a replacement puppy. All guarantees are exactly under the same terms
as the guarantee for hip dysplasia. This eye guarantee does not cover
injuries to the eye.
Buyer Warrants and Agrees:
1. This puppy shall be maintained and kept under the personal control of
the Buyer, and this puppy shall be given adequate housing, food, veterinarian
care and shall in no manner be mistreated or neglected.
2. This puppy shall not be used for breeding unless he/she has been x-rayed
to rule out hip dysplasia as certified by the O.F.A and is CERF certifiable.
The Seller is to be informed of the results of such examinations and of the
certification number. Should the dog be used for breeding before it is
x-rayed or has been determined to be CERF certifiable, whether intentional or
accidental, the Buyer shall release Seller of this guarantee and forfeit all
replacement rights.
4. This dog shall not be bred to any other breed other than an AKC Labrador
Retriever.
